HERKIMER - James P. ODonnell, Jr., 84, of 814 West German Street, Herkimer, died at home on Friday, February 4, 2005. Judge ODonnell, son of the late James P. ODonnell, Sr., and Mabel (Bond) ODonnell, was born on March 20, 1920, received his education at St. Francis deSales and graduated in 1938 from Herkimer High School. He entered Cornell University in 1938 leaving in 1942 to enlist in the U.S. Marine Corps. As a member of the First Marine Division, he participated in the Battles of Guadalcanal and Cape Gloucester in the South Pacific. He was wounded in combat and awarded the Purple Heart. He was discharged as a Second Lieutenant. On discharge from the service, Judge ODonnell resumed his education at Albany Law School in 1946 and was admitted to the New York State Bar in 1949. Husband of fifty-seven years to Laura E. (Hickey), he is survived by his son J. Peter ODonnell III of New Milford, CT, and daughters Marianne E. ODonnell of Arlington, MA and Catherine ODonnell McClelland of Hamilton, MA and grandchildren John Patrick, Michael M., William James and Grace C. ODonnell of New Milford CT, F. Keppler, Annie D., and James Peter McClelland of Hamilton, MA. Judge ODonnell is also survived by his sister, Betty ODonnell Bassett, of Syracuse, his brother, Philip D. ODonnell, Sr., of Herkimer, and seventeen nieces and nephews. He was predeceased by his sister Mabel Bond Lounsberry and a brother, Daniel Bond ODonnell. Judge ODonnell entered law practice with his father and served as Herkimer Village Attorney and Herkimer County Attorney before being elected to the New York State Supreme Court in 1968. He served on the bench of the Supreme Court until 1983 when he was the first resident of Herkimer County in over a century to be appointed to the Appellate Division of the New York State Supreme Court, where he served until 1986. He was a member of the NYS Bar Association, Herkimer and Oneida County Bar Associations, NYS Trial Lawyers Association, Elks Club, the American Legion, the Veterans of Foreign Wars, the Military Order of the Purple Heart, and the U.S. Marine Corps League. Active in both civic and community life, Judge ODonnell was a member of St. Francis de Sales Parish, where he served as an usher for over fifty years. He was a founding member of the Herkimer Pop Warner League, and was awarded the Distinctive Citizenship Award by the Boy Scouts of America in 1991. Judge ODonnell donated the Criminal Justice Laboratory to Herkimer County Community College in honor of his father, James P. ODonnell, Sr., and his uncle, Attorney Frederick J. ODonnell. Callings hours in Fenner Funeral Home Inc., 115 Court Street, Herkimer, will be on Sunday from 1:00 to 4:00 p.m. and Monday from 2:00 to 4:00 and 6:00 to 8:00 p.m. A Mass of Christian Burial will be celebrated in Saint Francis de Sales Parish, Herkimer on Tuesday at 11:00 a.m. Memorial donations may be made to St. Francis deSales Regional School Fund, the Salvation Army or the Boys Scouts of America. Envelopes will be available in the funeral home.
